These Terms of Use govern your access to and use of Tale Tandem ("TT", "we", "us", "our"), an interactive storytelling web application operated as Tale Tandem in Switzerland. By creating an account or using TT, you agree to these Terms. If you do not agree, do not use TT.
You must be at least 13 years old to use TT. If you are under the age of legal majority where you live, you may use TT only if your parent or legal guardian has reviewed and accepted these Terms on your behalf and permits your use of the service. You may use TT only if doing so is lawful where you are located.
You are responsible for providing accurate account information, keeping your login credentials confidential, and all activity that happens through your account. TT may require email verification before allowing access to AI features.
TT provides AI-assisted interactive storytelling. Users make decisions for a protagonist, and TT generates story content and related outputs, including images and campaign-related AI content. TT is a creative entertainment tool and not a substitute for professional advice, emergency services, or factual authority.
TT uses OpenAI models and may change its model choices over time. At the effective date of these Terms, TT currently uses the following text-model tiers:

We may update, replace, or discontinue models, tiers, providers, or technical implementations at any time for reliability, pricing, safety, legal, or product reasons. Model availability is not guaranteed.
TT uses a prepaid credit and wallet system. AI features consume credits, and credits must be available before an AI action is performed. TT may block AI actions if your balance is too low or if a daily credit limit or hard cap would be exceeded.
Some new users may receive a one-time gifted starting balance. Gifted balances, promotional balances, and purchased credits may be shown together in your account balance unless stated otherwise.
Credits on TT are non-refundable, except where refund is required by applicable law. To the maximum extent permitted by law, purchased credits are not redeemable for cash, partially used balances are not refundable, unused balances are not refundable simply because you choose to stop using TT, and completed AI usage charges are not reversible merely because you dislike the creative result.
TT may impose minimum top-up amounts, maximum top-up amounts, action-specific hard caps, minimum per-call charges, and similar billing rules. Current pricing and limits may be shown in the app and may change over time. Payments are processed by Stripe. TT does not store full payment card details.
AI-generated content can be wrong, incomplete, misleading, inconsistent, biased, offensive, or unsuitable. Output is generated automatically, may not be unique, and may resemble content generated for other users. You are responsible for reviewing and deciding how to use any output.
Do not rely on TT for medical, legal, financial, mental health, emergency, or other professional advice.
You may submit prompts, story decisions, campaign details, character descriptions, background material, images, and other content ("Your Content"). You retain whatever rights you have in Your Content.
You grant TT a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, modify, and use Your Content as necessary to provide the service, generate AI outputs, maintain campaign state and story history, prevent abuse, enforce these Terms, comply with law, and improve security, reliability, and operations.
As between you and TT, and to the extent permitted by applicable law and third-party provider terms, TT does not claim ownership of the specific story and image outputs generated for your account solely because they were generated through TT. However, outputs may not be unique, others may receive similar output, and your rights in outputs may be limited by law, the rights of others, or third-party provider terms. You are responsible for ensuring your use of outputs is lawful.
TT relies on third-party services, including OpenAI, Stripe, Supabase, Render, Vercel, and Resend. By using TT, you acknowledge that some parts of the service depend on these third parties and their rules.
In particular, by using TT's AI features, you acknowledge and agree that your use must also comply with OpenAI's applicable terms and policies, including:
OpenAI may process content sent through TT according to OpenAI's own terms, policies, and product practices. That may include use of content for safety, abuse prevention, policy enforcement, service improvement, and, where permitted under OpenAI's terms or policies, model improvement or training-related purposes. TT does not control third-party terms or practices and is not responsible for them.
You must not use TT:
TT may use automated systems, logging, filters, rate limits, and provider moderation or safety tools to detect abuse, reduce harm, enforce policies, and protect the service. We may block, remove, refuse, or report content or accounts where we believe it is necessary for safety, legal compliance, or platform integrity.
TT stores account data, campaign data, and story history in order to provide the service. We do not guarantee permanent storage, export availability, or indefinite preservation of all content. Although TT may store transcripts and campaign data for operational reasons, you should not treat TT as guaranteed archival storage.
We may suspend, restrict, or terminate your access immediately if you violate these Terms, your use creates risk for TT, users, or third parties, required third-party services become unavailable, we are required to do so by law, or non-payment, fraud risk, chargeback abuse, or security concerns arise. You may stop using TT at any time. Termination does not automatically create a right to a refund.
TT is provided "as is" and "as available" to the maximum extent permitted by law. To the maximum extent permitted by law, TT disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and quiet enjoyment.
We do not guarantee that TT will be uninterrupted or error-free, that outputs will be accurate or suitable, that content will always be preserved, or that any model or tier will remain available.
To the maximum extent permitted by law, Tale Tandem and its operators, affiliates, suppliers, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business opportunity, or content, arising out of or related to your use of TT.
To the maximum extent permitted by law, the total liability of Tale Tandem for any claim arising out of or relating to TT will not exceed the greater of the amount you paid to TT in the 12 months before the event giving rise to the claim, or CHF 100. Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.
To the maximum extent permitted by law, you agree to indemnify and hold harmless Tale Tandem and its operators, affiliates, suppliers, and service providers from claims, liabilities, damages, losses, and expenses arising from Your Content, your misuse of TT, your violation of these Terms, or your violation of law or the rights of a third party.
We may update these Terms from time to time. If we make material changes, we may post the updated version on the site and update the effective date. Your continued use of TT after the updated Terms take effect means you accept the revised Terms.
These Terms are governed by the laws of Switzerland, excluding conflict-of-law rules, to the extent permitted by applicable law. Any dispute arising out of or relating to these Terms or TT will be subject to the competent courts in Switzerland, unless mandatory consumer law provides otherwise.
